Double Victory for Insite, Vancouver's Supervised Injection Site

The B.C. Court of Appeal has decided that the possession and trafficking provisions of the Controlled Drugs and Substances Act do not apply to Insite under the constitutional doctrine of interjurisdictional immunity. The decision reaffirms that constitutional responsibility for Insite rests with the provincial government. The Court also dismissed the federal government's appeal of an earlier decision by the B.C. Court Supreme Court, which held that sections 4(1) and 5(1) of the CDSA violate section 7 of the Canadian Charter of Rights and Freedoms.

B.C. Supreme Court Strikes Down WCB's "blatant error" test for interest

On September 9, 2009, the B.C. Supreme Court struck down the WCB's "blatand error" test for paying interest and directed the WCB to reconsider its interest policy. The order is the latest in Johnson v. British Columbia (Workers' Compensation Board).

WCB policy on interest subject to review by BC Supreme Court

On July 2, 2009, the BC Supreme Court decided that it will review the Workers Compensation Board's policy on human interest payments to injured workers. Under the policy, the WCB will only pay interest where it has discretion to do so if a "blatant error" necessitates a retroactive benefits payment. Johnson v. British Columbia (Workers Compensation Board) challenges the legality of the WCB's interest policy.
